Individuals who desire to partner with Trafficgainer.com and who would like to exchange traffic with others, please apply for a partnership and well review your offer. In those cases where there is mutual agreement well create a partnership account at our site where you will be able to determine which of our partners traffic you want through the use of our online broker system.
You also obligate yourself to verify time-to-time, but at least once per week the quality of the traffic being received. If you are not satisfied with the quality of some of the traffic you can at any time terminate traffic exchange.
Our partners decide how they’ll set-up the guidelines for each traffic exchange; How many clicks are permitted from the same IP per day; How much proxy traffic will be accepted; and from which geographic areas to accept traffic.

NO SPAM DAMAGES: Trafficgainer.com reserves the right to terminate any account which it believes, in its sole discretion, is transmitting or is otherwise responsible for any spam or other unsolicited bulk e-mail, including, but not limited to, instant messages, chat rooms, newsgroups, ICQ and IRC. Any account which is terminated for violating this provision of the terms of use will not be paid for any amounts due at the time of termination or thereafter and may not be allowed to participate in the Service or any other future Trafficgainer.com product or service. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you agree to pay Trafficgainer.com liquidated damages of five dollars ($5.00 USD) for each piece of spam or unsolicited bulk e-mail transmitted from or otherwise connected with your account, otherwise you agree to pay Trafficgainer.com's actual damages, to the extent such actual damages can be reasonably calculated.
TERMINATION: Trafficgainer.com and Web Publisher reserve the right to terminate participation in the Service at any time for any reason. If an account is terminated by Web Publisher and the amount due on such terminated account is less than six hundred dollars ($600.00 USD), such amount due shall be forfeited by the Web Publisher. Should an account be terminated by either party and the amount due on such terminated account is greater than or equal to six hundred dollars ($600.00 USD), Trafficgainer.com shall remit payment during the NORMAL payment period, provided however, no payments shall be made on accounts terminated as a result of fraudulent activity or any other actions which violate the terms of use (including the existence of content on Web Publisher's site that is inconsistent with Trafficgainer.com's Corporate Policies, as referenced in the Section entitled "PARTICIPATION IN THE SERVICE"). Any account for which the majority of the clicks generated are coming from duplicate or near duplicate IP addresses, or in a manner that deviates from standard accounts, may be terminated by Trafficgainer.com and all earnings shall be forfeited.
OTHER VIOLATIONS; REMEDY If Web Publisher violates, refuses to partake in their responsibilities under these terms and conditions, or commits fraudulent activity against Trafficgainer.com, Trafficgainer.com reserves the right to take appropriate legal action to cover its damages. Such activities include, but are not limited to, clicks generated as a requirement to enter or obtain access to goods and services on your (or someone else's) web site; use of any type of mechanism that assists in the false generation of clicks or maintaining such a mechanism; encouraging the use of or providing others with any type of mechanism that assists in the false generation of clicks; configuring the Service's link so that, when clicked on, the linked web site opens in a new browser window, in a pop-up window, or in frames; configuring the Service's link so that, when clicked on, such action opens an exit console; or any other actions which violate these terms of use. Trafficgainer.com reserves the sole right to determine what constitutes a violation of this provision.
MODIFICATIONS: Trafficgainer.com reserves the right to change any of these terms and conditions at any time without notice. Trafficgainer.com also reserves the right to terminate any account without any given reason at any time without notice. You are responsible for complying with any changes to the terms and conditions within ten days of the date of change. Partners who want to use our xml feed. We deal with web sites which have at least 1,000 unique visitors per day. Please read the rules very carefully before you sign up! The company keeps the right to send payments by check or any other method which seems more appropriate. By signing up as a partner you agree that if/when you want to discontinue business partnership youll send email notice at least 24 hours before to all Responsibility of Partners. Everyone who signs a contract with us as a partner must follow the all rules. Active Affiliate is an Affiliate with US IP who is sending average of at least 600 clicks daily. Visitors must enter through the result page (xml feed). No incentive searches or clicks are allowed. Proxy traffic, clicks with unusual time frame, incentive clicks are cause for immediate termination. Robotic traffic might cause a lot of trouble for one who is sending it. Foreign traffic from partner's to US advertisers is usually ignored by our partners and advertisers. If a partner sends to much foreign traffic we'll terminate that partners account. We accept traffic from all over the World. Partners decide if they want all or just a part of the traffic from any particular area. If you have your database of partners and want them to participate in our program, you can only invite them as direct partners, your referrals. Do not send them to your site as visitors, because this will cause automatic activation of filters, which will disable the normal activities of your account. You are rewarded for referrals on a permanent 5%. We won't prohibit searches, we'll just prevent any incentive clicks and fraud. We regulate visitors and advertisers through the use of automatic filters. We encourage you to search with us and refer as many referrals as possible. Referrals are the key to success. Instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by this company be detected it may result in partner termination and possible legal action. Partners of all countries are welcome to participate in our program. The relationship of the Parties to this Company are as independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and this company. You understand that you do not have the authority to make or accept any offers or make any representations on behalf of this company. You may not make any statements, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using this company’s program. Limitation of Liability Company will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or company program, even if this company has been advised of the possibility of such damages. Furthermore, the company aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. The payments partners will be paid by check or online payment system of our choice. You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your partnership with this company and may result in legal prosecution. This company strictly enforces anti-spamming laws. Spamming is a federal crime. Any partner caught spmming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. This company may charge up to $5 per spam email sent. Multiple signups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. This company will file charges for the recovery of any earnings received from multiple signups. This company reserves the right to reject or remove any partner if it is deemed unsuitable for the company program. You agree that you are solely responsible for defending any claim, and for payment of damages or losses resulting from the foregoing to both a third party and to this company. MODIFICATIONS TO THE SERVICE:
This company reserves the right to change the general practices, rules and limits at any time, in its sole discretion, with or without notice. The company reserves the right to at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the company shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. All emails from partners who send spam, use inappropriate language or just want to take advantage of the program will be erased and their accounts terminated. All accounts with fake data, fake or disconnected phone numbers, and/or other scam/fraudulent intensions will be terminated. We reserve the right to check from time to time if the data, emails and/or phone numbers are valid. If we see that the phone number doesn't work, data information is fake or the email is inactive, we'll close that account.
